1. Acceptance of Terms

By accessing or using DigiWill ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. DigiWill is operated by DigiWill and is accessible at app.digiwill.io.

2. Description of Service

DigiWill is a digital legacy and estate management platform that allows users to securely store, organize, and transfer digital assets (such as account credentials, documents, and personal notes) to designated heirs. The Service uses zero-knowledge client-side encryption — your data is encrypted in your browser before being stored.

3. Eligibility

You must be at least 18 years old to use DigiWill. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.

4. Account Responsibility

You are responsible for maintaining the security of your account credentials and encryption passphrase. DigiWill cannot recover your encryption key or the contents of your encrypted assets if you lose your passphrase or key file — this is by design. You are solely responsible for backing up your key file.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes third-party intellectual property rights
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated tools to scrape, crawl, or overload the Service
  • Impersonate another person or entity

6. Subscriptions & Payments

DigiWill offers free and paid subscription plans. Paid plans are billed monthly or annually via Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by law.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with the EU General Data Protection Regulation (GDPR).

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. DigiWill does not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for maintaining backups of your key file and critical data.

9. Limitation of Liability

To the fullest extent permitted by applicable law, DigiWill shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data or inability to access encrypted content.

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time from your profile settings. Upon deletion, your data will be permanently removed within 30 days.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the European Union and applicable member state law. Any disputes shall be resolved in the courts of competent jurisdiction.
